Important: When our customers use our Services to collect, manage, or process personal information about their own clients, leads, employees, or end-users, our customers are responsible for that information. In those circumstances, ROAR Funnels acts as a data processor, not a data controller.
2. Roles & Responsibilities
2.1 Our Role (Data Processor)
ROAR Funnels processes personal information solely on the instructions of our customers and for the purpose of providing the Services.
2.2 Our Customers’ Role (Data Controllers)
Our customers:
- Determine what personal information is collected
- Determine the purposes and legal basis for processing
- Are responsible for providing appropriate privacy notices to their end-users
- Are responsible for responding to privacy rights requests from their end-users
- If you are an end-user of one of our customers and have questions about your personal information, please contact the organization that directed you to our Services.

Depending on how the Services are used, we may process the following categories of personal information:

3.1.1 SMS & Messaging Communications
A. Messages Sent by ROAR Funnels
By providing your phone number, you consent to receive SMS messages from ROAR Funnels related to:

Message frequency may vary. Message and data rates may apply. You may opt out at any time by replying STOP.
ROAR Funnels does not sell or share SMS consent with third parties for their marketing purposes.
B. Messages Sent by Customers Using the Platform
Our Services may also enable customers to send SMS or other messaging communications to their own contacts or end-users.
In these cases:
- Messages are sent by or on behalf of the customer, not ROAR Funnels
- Customers are solely responsible for obtaining all required consents and opt-ins
- Customers must comply with all applicable messaging laws and regulations, including A2P 10DLC, TCPA, CASL, and similar frameworks
- Customers are responsible for managing opt-out requests (such as STOP commands), message content, timing, and recipients
ROAR Funnels does not control, review, or endorse customer-initiated messaging content and is not responsible for carrier filtering, blocking, or delivery failures related to such messages.
3.2 Information Processed on Behalf of Customers
- CRM contact details (names, emails, phone numbers)
- Client communications and notes
- Uploaded files and records
- Any other personal information customers choose to process using the Services
3.3 Automatically Collected Information
- IP address
- Device and browser information
- Usage and interaction data
- Log files and analytics data
4. How We Use Personal Information
We use personal information to:
- Provide, operate, and maintain the Services

5.3 Customer Responsibility
Customers must not submit personal information to AI features unless they have the appropriate authority and legal basis to do so.

- Service providers and subprocessors, including:
- Payment processors (e.g., Stripe)

- Cloud hosting and infrastructure providers

By creating an account, subscribing to a plan, or using any part of the Services, you (“Client,” “you”) agree to be bound by these Terms.
1. Services Provided
The Company provides:
- Access to a software-as-a-service platform (including CRM, automation, email, AI, and related tools)
- Optional setup and implementation services
- Ongoing technical support
- Strategy, consulting, and training services (available only under certain plans or memberships)
- Templates, workflows, and prebuilt assets
- Services may change over time, and features may vary by plan.
2. Eligibility & Account Use
You confirm that:
- You are at least 18 years of age
- You have authority to bind your business to these Terms
- You will use the Services only for lawful purposes
- You are responsible for all activity occurring under your account
3. Client Responsibilities & Compliance
You are solely responsible for:
- Compliance with all applicable laws and regulations (including HIPAA, PIPEDA, GDPR, CAN-SPAM, CASL, A2P 10DLC, and similar)
- Obtaining all required consents from your end users
- The content you upload, generate, send, or store using the Services
- Ensuring your messaging, data collection, and communications are lawful
The Company does not provide legal, regulatory, or compliance advice.
4. Messaging, Email & A2P Compliance
The platform enables email and AI-assisted messaging.
You acknowledge and agree that:
- You are responsible for all email and message content
- You must comply with all carrier, platform, and regulatory rules
- The Company is not responsible for filtering, blocking, delivery failures, penalties, or fines imposed by third parties
- We may suspend or terminate accounts for non-compliant messaging, at our sole discretion
5. AI Features
Certain AI features are:
- Optional
- Paid
- Opt-in only
By enabling AI features, you acknowledge that:
- AI outputs are generated automatically and may be inaccurate
- AI outputs do not constitute professional, legal, medical, or financial advice
- You are responsible for reviewing, approving, and using AI-generated content
The Company makes no guarantees regarding AI accuracy or outcomes
6. Fees, Billing & Subscriptions
a) Subscriptions
- Plans may be monthly or annual
- Fees are billed in advance
- All fees are charged in CAD for Canada-based clients and USD for all others
- Subscriptions renew automatically unless canceled
b) Setup & Implementation Fees
Setup or “Done-for-You” fees are non-refundable
c) Usage-Based Fees
Additional charges may apply for usage (e.g., email, AI, integrations)
d) No Refunds
All subscription fees and setup fees are non-refundable, unless otherwise required by law.
7. Late Payments, Suspension & Termination
- Late fees may apply
- Accounts may be suspended for non-payment
- Accounts may be terminated after 15 days of non-payment
- The Company may suspend or terminate access immediately for violations or legal risk
8. Subscription Pause & Reactivation
a) Subscription Pause
Clients may pause their subscription for a monthly fee of

b) Cancellation & Reactivation
- Upon cancellation, account data is retained for three (3) months
- After three months, data is permanently deleted
- Reactivation within the three-month period incurs a reactivation fee of
9. Support
- Support is provided on a commercially reasonable basis
- Typical response time: 24–48 business hours
- No guarantee of resolution time is provided
10. Availability & Uptime
- The Services are provided “as is” and “as available.”
- No uptime or uninterrupted access guarantees are made
- Maintenance, updates, or outages may occur without notice
11. Intellectual Property
- All software, content, templates, workflows, branding, and materials are owned by or licensed to ROAR Funnels.
- You are granted a limited, non-exclusive, non-transferable license to use the Services during your subscription.
12. Brand Use & Misuse
You may not:
- Misrepresent your relationship with ROAR Funnels
- Use the ROAR Funnels's branding in a misleading or unauthorized way
- Imply endorsements or guarantees without written permission
13. Data & Privacy
The Company acts as:
- Data Controller for account and billing data
- Data Processor for client and end-user data
Data handling is governed by the ROAR Funnels Privacy Policy.
14. Limitation of Liability
To the fullest extent permitted by law:
- The Company is not liable for indirect, incidental, or consequential damages
- Total liability is capped at the fees paid by you in the preceding 12 months
15. Indemnification
You agree to indemnify and hold ROAR Funnels harmless from any claims, losses, or liabilities arising from:
- Your use of the Services
- Your content or communications
- Your failure to comply with laws or regulations
16. Termination
ROAR Funnels may:
- Terminate services with notice
- Terminate immediately for violations or legal risk
- Remove access without liability upon termination
17. Governing Law
These Terms are governed by the laws of:
- The Province of Alberta
- The laws of Canada, without regard to conflict-of-law principles
18. Changes to These Terms
